CHESSMAX – TERMS & CONDITIONS & PRIVACY POLICY

These Terms and Conditions ("Terms") constitute a legal agreement between you ("User," "Player," or "You") and ZOIHUB LLC ("Company," "We," "Us," or "Our") governing your use of the Chessmax mobile and web-based gaming application ("Application" or "Game").

By accessing, downloading, installing, or participating in the Game, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please discontinue using the Game immediately.

1. NATURE OF THE GAME

Chessmax is a skill-based multiplayer chess game that may include both free and paid tournaments. All outcomes in Chessmax are determined solely by players' skills, strategies, and decision-making abilities.

No element of the game involves chance, gambling, betting, or random outcomes.

2. TOURNAMENTS & PAYMENTS

  • Paid Participation: Certain tournaments or features within Chessmax may require an entry fee. These fees are used to facilitate gameplay, server operations, and prize distribution.
  • No Guaranteed Returns: Paying an entry fee does not guarantee any reward or monetary return. Prizes are distributed only based on performance and results within the game.
  • Fair Play: All players are expected to play honestly. Any cheating, use of external software, manipulation, or unfair advantage is strictly prohibited.
  • Cheating or Misconduct by Others: ZOIHUB LLC is not liable for any damages, losses, or outcomes resulting from cheating or misconduct by other players. The Company reserves the right to suspend or ban such users at its sole discretion.

3. LICENSE GRANT

You are granted a limited, non-exclusive, revocable, non-transferable license to use the Game for personal entertainment in accordance with these Terms.

4. USER RESPONSIBILITIES

You agree not to:

  • Copy, modify, or redistribute the Game or any of its content;
  • Reverse-engineer or extract the source code;
  • Use bots, hacks, or third-party automation software;
  • Attempt to manipulate tournament results or game rankings;
  • Engage in any fraudulent or deceptive activities.

5. COMPANY RIGHTS AND DISCLAIMERS

  • The Company reserves the right to change tournament structures, entry fees, and prize distributions at any time.
  • We may suspend, ban, or delete accounts violating these Terms without prior notice.
  • We do not guarantee that the Game will be error-free, uninterrupted, or immune from external interference.
  • The Company is not responsible for:
    • Network issues, disconnections, or device malfunctions;
    • Misconduct by other players;
    • Unauthorized access to your account by third parties.

6. LIABILITY LIMITATION

To the fullest extent permitted by law, ZOIHUB LLC shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of your use or inability to use the Game, including but not limited to loss of earnings, data, or reputation.

7. ACCOUNT SECURITY

You are responsible for maintaining the confidentiality of your login information. You agree to notify the Company immediately if you suspect unauthorized access to your account.

8. PRIVACY POLICY

8.1. Data We Collect

We may collect:

  • Account information (username, email, password);
  • Device identifiers, IP address, and general location;
  • Gameplay data, statistics, and tournament history;
  • Payment information processed securely via third-party providers.

8.2. Use of Data

Collected data is used to:

  • Operate and improve the Game;
  • Prevent fraud, cheating, and abuse;
  • Provide customer support;
  • Process payments and display leaderboards.

We do not sell personal data to third parties.

8.3. Data Storage and Security

Your data is stored securely on servers managed by reputable third-party providers. While we take all reasonable measures to protect your data, no digital platform is 100% secure, and we cannot guarantee absolute protection.

8.4. Data Sharing

We may share limited data with:

  • Payment processors (e.g., Google Play, Apple);
  • Analytics or anti-fraud partners;
  • Legal authorities, if required by law.

9. TERMINATION

We may suspend or terminate your access at any time without notice if you:

  • Breach any term of this Agreement;
  • Attempt to defraud or manipulate tournaments;
  • Engage in abusive or harmful conduct toward others.

Upon termination, you lose access to your account and any virtual items or balances.

10. MODIFICATIONS

We reserve the right to update or modify these Terms and the Privacy Policy at any time. The revised version will be effective immediately upon posting within the Application or on the official website.

11. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of New Jersey, USA, without regard to its conflict of law principles.
